Woodridge Driver Found Not Guilty of DUI

A driver involved in a rainy-evening rear-end collision is charged with DUI despite refusing all chemical testing — and is found not guilty at trial after our team exposes contradictions between the police report and dash-cam video.
Driving in rain makes for poor visibility and slippery roads. In 2019, after an auto accident in Woodridge, Illinois, our client was charged in DuPage County with DUI of alcohol and/or drugs.
On a rainy evening around 10 p.m., our client applied his brakes as he approached an intersection. His tires slid and he collided with a vehicle stopped at a red light. Both parties pulled into a gas station and called police.
Dash-cam footage showed the officers slipping into a “good cop, bad cop” routine. They let the other party go and turned to our client, who maintained he had not consumed alcohol or drugs. Despite repeated aggressive questioning, he was consistent. He refused the field sobriety test, was placed in custody, and refused all blood, breath, and urine testing.
The police report was long and detailed — but inconsistent with the dash-cam video. The report said our client was swaying and needed to brace himself on the vehicle and gas pump. That did not appear on video. The report said he initially admitted to drinking. That did not appear in the video or audio either.
At the second court date, the prosecution offered court supervision. Normally a strong offer, but because we believed they couldn’t prove the case beyond a reasonable doubt, we advised trial — and our client agreed.
At trial, two DDT attorneys cross-examined the officer, got him to admit inconsistencies, and got the other driver to admit he didn’t smell alcohol and didn’t initially believe our client was intoxicated. The judge watched the dash-cam video closely, acknowledged our client had slurred speech and strange answers, and agreed the officers had been justified in their arrest — but ruled he could not find our client guilty of DUI beyond a reasonable doubt. Our client was found innocent.
