DUI and Leaving the Scene of an Accident
By: Attorney Derek Martin
A client arrested for DUI, failing to report property damage, illegal transportation of alcohol, and driving without insurance — after fleeing a three-car crash that left a tire at the scene — avoids a DUI conviction and gets his driving privileges reinstated.
In November 2021, a client reached out to Driver Defense Team looking for representation on multiple charges: Driving Under the Influence of Alcohol, Failing to Report Property Damage After an Auto Accident, Illegal Transportation of Alcohol, and Operating a Vehicle Without Insurance.
In the early morning hours of a cold November night, our client was driving down a public roadway when he struck three parked vehicles. The impact caused significant damage to both his own vehicle and the parked cars. Witnesses heard the crash and contacted the Chicago Police Department. When officers arrived, the suspect was gone.
During the accident, the suspect’s vehicle lost a tire that remained at the scene. The vehicle then continued down the road without that tire, leaving unsightly damage to the roadway. Chicago Police followed the roadway damage to our client’s residence, where they found a parked vehicle missing a tire — and our client in front of it with a visible bottle of alcohol.
He was arrested on all four charges. At the station, he refused all testing, triggering an automatic one-year license suspension.
When our client first called, he explained that his ability to drive to work was the most important thing in his life. Our attorneys collected all discovery. On paper the deck was heavily stacked against him — but our experienced negotiators assembled his mitigation, worked the prosecutor, and ultimately avoided a DUI conviction while preserving his driving privileges.

October 6, 2026“Had 4 different cases that tied into one and this team resolved all of them that (some) have been open since 2021, which is how long I’ve been without a license. Contacted them in July 2026 after receiving 2 back to back cases on top of 2 already being open and I received my license back in September with only supervision. This team stays in constant communication and was always readily available to text and/ or call with all answers to my questions and concerns being from I’m from another state and only work around the area. Thanks team, you’re appreciated .”

October 6, 2026“I don't think I could've gotten through my DUI without them. They brought my charges down to a misdemeanor, made sure I was aware of every single court date, ensured that I understood everything, and that all essential information was communicated thoroughly and effectively. When I missed a court date on accident, they were able to help me get the warrant dismissed and set a new court date, and reminded me the previous night. All in all, I truly believe that money was well spent with them and I would recommend them to anyone going through a DUI or anything similar.”
