DDT Client Gets License Back After DUI at Bridgeview Courthouse
By: Attorney Derek Martin
A client arrested while sleeping in his truck after an argument with his wife is found not guilty on all charges, and the judge orders his one-year driver's license suspension terminated immediately.
Most married couples are prone to an argument or two. For one client, the consequence of a dispute with his wife led to a DUI charge.
One morning in March 2019, the Burbank Police Department approached our client while he slept in his truck near the intersection of 85th Street and Lamon Avenue. Rather than continue to argue the night before, he had gone to his truck to sleep. When police arrived, officers observed two cans of beer in his truck and began a DUI investigation.
After the field sobriety test — during which the officers indicated our client had successfully completed the one-leg stand — they still claimed signs of impairment on that same test and on the horizontal gaze nystagmus test. Believing they had reasonable suspicion, they requested a chemical alcohol test. Our client refused, and the Illinois Secretary of State suspended his driving privileges for one year.
We filed the paperwork to preserve his right to dispute the suspension. After reviewing the Burbank PD’s reports and dash-cam video, it became clear the state would have a difficult time proving its case. When the prosecutor’s plea offer wasn’t in our client’s best interest, we recommended trial.
At trial, we showed the judge that our client’s performance on the standardized field sobriety test was not indicative of intoxication, and that there was no proof he had operated his vehicle improperly. The judge noted the beer cans that launched the investigation were empty — which had no bearing on whether he was intoxicated.
The judge ruled the state did not prove its case. Our client was found innocent of all charges, and the judge ordered his driver’s license suspension terminated immediately.

October 6, 2026“Had 4 different cases that tied into one and this team resolved all of them that (some) have been open since 2021, which is how long I’ve been without a license. Contacted them in July 2026 after receiving 2 back to back cases on top of 2 already being open and I received my license back in September with only supervision. This team stays in constant communication and was always readily available to text and/ or call with all answers to my questions and concerns being from I’m from another state and only work around the area. Thanks team, you’re appreciated .”

October 6, 2026“I don't think I could've gotten through my DUI without them. They brought my charges down to a misdemeanor, made sure I was aware of every single court date, ensured that I understood everything, and that all essential information was communicated thoroughly and effectively. When I missed a court date on accident, they were able to help me get the warrant dismissed and set a new court date, and reminded me the previous night. All in all, I truly believe that money was well spent with them and I would recommend them to anyone going through a DUI or anything similar.”
