Here’s what people have to say

Getting charged with a DUI turns your world upside down. One minute you’re driving home, the next you’re in handcuffs and facing serious criminal charges that could affect your entire future.

When a DUI conviction is on the table, many of our clients wonder how they should respond and what their best course of action is.

We know how overwhelming and scary a DUI can be.

It might be your first DUI offense. Maybe you’re a commercial driver and can’t risk getting a criminal record. Or you might be a nurse and scared of losing your job.

We’ve helped thousands of drivers throughout Chicago get the best results. And we can do the same for you.

When is a DUI a felony?

You might assume that felony DUI charges only apply to repeat offenders, and while subsequent offenses are usually charged as felonies, that’s not the whole story.

Even a first DUI can be charged as a felony in certain circumstances.

It’s your third or more DUI offense

Any third DUI conviction in Illinois automatically becomes a Class 2 felony, regardless of how much time has passed since your previous offenses. This means if you had a DUI 15 years ago and another one five years ago, a third arrest today will still be charged as a felony.

Fourth and subsequent DUI convictions are even more serious, elevating to Class 1 or Class X felonies with the potential for decades in prison.

First or second DUI with aggravating factors

Even if this is your first or second DUI, which are usually misdemeanors, certain circumstances can elevate the charge.

If you were driving under the influence and caused an accident that resulted in great bodily harm, you’ll face a Class 4 felony charge.

When someone dies as a result of your DUI, the charges become even more severe.

Your driving status at the time of arrest can also elevate a DUI to a felony level. If you were driving while your license was suspended or revoked due to a previous DUI, you’ll be charged with aggravated DUI, a Class 4 felony.

Driving without a valid license or without required insurance coverage also elevates a DUI to a Class 4 felony. These charges recognize that drivers who ignore basic legal requirements pose additional risks to public safety.

The presence of certain passengers can significantly increase the severity of DUI charges. If you were driving under the influence while transporting children under 16 years old, you’ll face enhanced penalties.

Similarly, if you were driving a school bus with passengers under 18 or operating a vehicle-for-hire with passengers, your DUI becomes a Class 4 felony. These situations involve a breach of the special trust placed in professional drivers.

Felony DUI penalties in Illinois

So what’s the difference between a misdemeanor and a felony DUI?

Both are serious, and both will give you a criminal record if you’re convicted.

A typical first DUI in Illinois is a Class A misdemeanor with a maximum penalty of one year in county jail and up to $2,500 in fines. But a felony DUI is a whole different ballgame.

Class 4 felony DUI

  • 1 to 3 years in state prison
  • Fines up to $25,000.

Class 3 felony DUI

  • 2 to 5 years in state prison
  • Fines up to $25,000.

Class 2 felony DUI

  • 3 to 7 years in state prison
  • Fines up to $25,000.

Class 1 felony DUI

  • 4 to 15 years in state prison
  • Fines up to $25,000.

Class X felony DUI

  • 6 to 30 years in state prison
  • Fines up to $25,000.

On top of these harsher penalties, Illinois law requires mandatory minimum sentences for all felony DUI convictions. Even if you’re eligible for probation, you’ll spend at least 10 days in jail or need to complete 480 hours of community service.

How to fight a felony DUI charge

Facing felony DUI charges doesn’t mean conviction is inevitable. The right defense strategy can result in reduced charges, case dismissal, or a not-guilty verdict. The key is finding the weaknesses in the State’s case. Every case is different, and the potential outcomes for you will depend on your driving history, the evidence against you, and how the stop and arrest were done. Common strategies for fighting an aggravated DUI charge include:

Challenging the traffic stop

Every traffic stop must be legally justified. In other words, law enforcement needs reasonable suspicion of a traffic violation or criminal activity to pull you over. An officer can’t just pull you over because they feel like it and then decide to investigate you because your eyes are bloodshot or you’re understandably acting nervous. If the stop wasn’t lawful, all evidence gathered afterward may be inadmissible, and the prosecution’s case collapses.

Questioning field sobriety tests

Field sobriety tests are subjective and prone to error. Many factors unrelated to intoxication can affect performance, including medical conditions, fatigue, anxiety, poor lighting, or uneven surfaces.

Challenging chemical test evidence

Breath and blood tests must be conducted according to strict requirements to be admissible in court. Equipment must be properly calibrated and maintained, operators must be certified, and proper procedures must be followed throughout the testing process.

Even small procedural errors can result in test results being excluded from evidence. We can also argue that a time delay between the initial stop and the chemical test indicates that you were not intoxicated when you were stopped.
