Woodridge Driver Avoids Aggravated Speeding Conviction
By: Attorney Derek Martin
A PhD student charged with aggravated speeding — a Class A Misdemeanor — wins a supervision sentence over the prosecutor's objection, preserving his student visa and his scientific career.
Our main goal in every case is to obtain the best possible outcome for our client. A review of your case can reveal different actions — trial, negotiation, or preparing for the best possible sentencing.
In summer 2019, the Woodridge Police Department charged our client with aggravated speeding, a Class A Misdemeanor, for allegedly driving 81 MPH in a 35 MPH zone. He was ordered to appear at the Downers Grove Field Court in DuPage County. After reviewing the case, we determined a trial would not serve him.
A Class A Misdemeanor carries a potential penalty of up to one year in jail — but the real concern was his immigration status. Our client was a scientist completing his PhD in Illinois and was in the process of renewing his student visa. A criminal conviction would jeopardize his ability to complete his studies, damage his ability to work, and potentially change his immigration status.
We gathered mitigation and presented it to the state’s attorney. Despite the positive information, the prosecutor was restricted by office policy and would not offer a reduced charge.
This could have been the end of the story — but a judge has the final word at sentencing. Working with our client’s immigration attorney, we agreed a supervision sentence would let him renew his visa and continue his path. A judge can order supervision even over the prosecutor’s objection, and that’s exactly what happened here. Our client received a supervision sentence, keeping a conviction off his record.

October 6, 2026“Had 4 different cases that tied into one and this team resolved all of them that (some) have been open since 2021, which is how long I’ve been without a license. Contacted them in July 2026 after receiving 2 back to back cases on top of 2 already being open and I received my license back in September with only supervision. This team stays in constant communication and was always readily available to text and/ or call with all answers to my questions and concerns being from I’m from another state and only work around the area. Thanks team, you’re appreciated .”

October 6, 2026“I don't think I could've gotten through my DUI without them. They brought my charges down to a misdemeanor, made sure I was aware of every single court date, ensured that I understood everything, and that all essential information was communicated thoroughly and effectively. When I missed a court date on accident, they were able to help me get the warrant dismissed and set a new court date, and reminded me the previous night. All in all, I truly believe that money was well spent with them and I would recommend them to anyone going through a DUI or anything similar.”
