A Motion to Vacate: Bringing Your Traffic Ticket Back to Life
By: Attorney Eric Tibbs
A driver facing license suspension after failing to appear on multiple tickets wins a motion to vacate, reopens the case, and avoids a hit to his record and insurance rates.
It can be a scary moment when you get a letter from the Illinois Secretary of State telling you that your license is going to be suspended. This can happen when you fail to appear in court for multiple traffic tickets, or when you fail to appear for an insurance ticket.
A motion to vacate is an action that asks the judge to reopen your case so that a suspension hold may be lifted from your driving record. Once the hold is lifted, you can resolve the underlying ticket so that it doesn’t go on your record and, in most cases, doesn’t affect your insurance rates.
When you fail to appear in court, there are several actions that the circuit clerk or the judge may take. Your license may be suspended by a judge, or the ticket may be entered as an “automatic conviction.” The judge can also report your failure to appear to the Secretary of State, who will then suspend your license and make you return to court to resolve the ticket.
Counties in the Chicagoland area treat failure to appear differently. Some judges are harsher with a motion to vacate and only allow you to reopen the case if you act quickly. Hiring an attorney from Driver Defense Team helps you navigate the process — we handle motion-to-vacate cases several times a week, and we get the proper paperwork hand-delivered to representatives of the Illinois Secretary of State once the case is resolved.
A motion to vacate is even more critical for CDL holders. A commercial driver who fails to appear on a traffic ticket risks losing not just their personal driving privileges but their livelihood. In that situation, the ticket will typically need to be amended to a non-moving violation — often an “obstructed windshield” — which requires negotiation with the prosecutor and judge.

October 6, 2026“Had 4 different cases that tied into one and this team resolved all of them that (some) have been open since 2021, which is how long I’ve been without a license. Contacted them in July 2026 after receiving 2 back to back cases on top of 2 already being open and I received my license back in September with only supervision. This team stays in constant communication and was always readily available to text and/ or call with all answers to my questions and concerns being from I’m from another state and only work around the area. Thanks team, you’re appreciated .”

October 6, 2026“I don't think I could've gotten through my DUI without them. They brought my charges down to a misdemeanor, made sure I was aware of every single court date, ensured that I understood everything, and that all essential information was communicated thoroughly and effectively. When I missed a court date on accident, they were able to help me get the warrant dismissed and set a new court date, and reminded me the previous night. All in all, I truly believe that money was well spent with them and I would recommend them to anyone going through a DUI or anything similar.”
