A Motion to Quash and Suppress: A Legal Maneuver to Win Your Case
By: Attorney Eric Tibbs
A client cited for driving on a revoked license — pulled over for a 4x4-inch air freshener — wins a Motion to Quash and Suppress, gets the ticket dismissed, and resumes his Secretary of State reinstatement process.
Many clients call Driver Defense Team asking a single question: what can you do to “win” my case? “Winning” can take many forms — a not guilty at trial, court supervision that keeps a conviction off your record, or a lesser-known approach: a Motion to Quash and Suppress the Arrest.
This maneuver keeps evidence out of court. Evidence gathered during a traffic stop can be excluded if the officer did not have an articulable, reasonable suspicion to initiate the stop in the first place. In this case, the basis of the stop came down to one small item: an air freshener.
Our client received a “driving while license revoked” ticket. His license was revoked from a DUI years earlier, and he was actively working on reinstatement when he was pulled over. The officer stated the reason for the stop was the air freshener hanging from the rearview mirror — nothing else.
The Illinois Vehicle Code doesn’t allow obstructions of the driver’s view, but People v. Mott clarifies that any object hanging from the rearview mirror must “materially obstruct” the view such that the driver cannot safely operate a car.
The air freshener in question was roughly 4 inches by 4 inches. We argued it could not be thought of as a material obstruction. The judge agreed, our Motion to Quash and Suppress was granted, and the driving-while-revoked ticket was dismissed — allowing our client to continue his Secretary of State reinstatement hearing and get his valid license back.
