DUI Defense

Illinois DUI defense for out-of-state drivers

A DUI arrest while visiting or passing through Illinois can follow you home. We handle the Illinois side so you're not navigating an unfamiliar court system from another state.

Getting a DUI arrest far from home is scary. You may not know if you can still drive. You may not know how an Illinois court can touch a license from another state.

Here is the short version. Illinois can charge you with a DUI even if your license is from another state. The case stays in Illinois. What happens here can follow you home.

Driver Defense Team focuses on traffic and DUI defense. We help out-of-state drivers with Illinois DUI cases from our Chicago and Villa Park offices. We are in Cook, DuPage, Kane, Lake, and Will County courts. Call for a free case review: (312) 487-4700.

Illinois can charge you no matter where your license is from

A DUI is based on where the alleged offense happened — not where you live and not where your license was issued. If you were arrested in Illinois, your case belongs in that Illinois county court.

Illinois rules apply. Same legal limit. Same questions about the stop, the breath or blood test, and the field tests. Same court process as any other Illinois DUI case. For the bigger picture, see our DUI defense page.

Two tracks at once: the criminal case and the summary suspension

Every Illinois DUI arrest starts two separate matters. Out-of-state drivers face both:

  • The criminal DUI charge. The court and prosecutor handle this. It decides conviction and criminal penalties.
  • The statutory summary suspension. This is an automatic hit to your driving privileges. It is separate from the criminal case. It usually starts on the 46th day after the arrest notice unless you challenge it in time. The window to challenge is short. If this is a first case, also see our first offense DUI page. For DUI defense overall, start at DUI.

For an out-of-state driver, the summary suspension hits your privilege to drive in Illinois. The officer cannot take away the license your home state gave you. That does not mean you are safe — because of what happens next.

Your home state will likely find out

Illinois is in the Driver License Compact. That is a pact most states use to share major traffic and DUI cases with each other. When Illinois arrests you for DUI, it usually reports that to your home-state licensing agency.

Many states then treat an out-of-state DUI like one that happened at home. They may suspend or penalize your license under their own rules. So a strong Illinois outcome matters for more than driving in Illinois. It can shape what your home state does next. Every state is different. Your home-state license rules belong to that state. But the Illinois result often starts those next steps.

Why this is harder alone when you live elsewhere

On top of a normal Illinois DUI, you also deal with distance and a system you do not know:

  • Court dates are in the Illinois county of the arrest — not near home.
  • The short deadline to challenge the summary suspension does not pause because you went home.
  • You are tracking an Illinois court case and a possible home-state reaction at the same time.

Local counsel helps here. Someone who is in these courthouses often can manage the Illinois process while you plan from another state.

How we help

We handle the Illinois side of an out-of-state DUI from start to finish. We review the stop, the arrest, and the testing. We address the statutory summary suspension inside its deadline. We work to resolve the criminal charge as well as the facts allow.

Court dates: A DUI is criminal. You appear for criminal dates — in person, or by Zoom only if that court authorizes Zoom for that date. On some dates, if the court allows it, your attorney may cover the appearance. We tell you what each date requires so you are not guessing about travel.

We practice Illinois law, so we focus on the Illinois case. We also help you understand how that outcome can affect your home-state license so nothing sneaks up on you.

If you were arrested for DUI in Illinois and your license is from another state, talk to us first. Free case review. No obligation. The sooner we are involved, the more we can do about that suspension deadline.

Frequently Asked Questions

Can Illinois charge me with a DUI if I have an out-of-state license?

Yes. A DUI charge is based on where the alleged offense happened, not where your license is from. If you were arrested in Illinois, the case stays in that Illinois county — even if another state issued your license.

Can an Illinois officer take away my out-of-state license?

An Illinois arrest does not cancel a license from another state — only your home state can do that. Illinois can suspend your privilege to drive in Illinois. It also reports the arrest to your home state through the Driver License Compact (a pact most states use to share serious traffic and DUI cases). Your home state may then act under its own laws.

Do I have to travel back to Illinois for court?

A DUI is a criminal charge, so you are expected to appear. Which dates need you in person — and which your attorney may cover if the court allows — depends on the court, the judge, and the stage of the case. We tell you what each date requires so you can plan travel. For a criminal DUI date, you appear in person, or by Zoom only if that court authorizes Zoom for that date.
