Traffic Tickets
Your options after an Illinois traffic ticket
If you get a traffic ticket in Chicago or the suburbs, the back of the ticket or the envelope usually lists three ways to handle it. County rules differ, but those three paths show up almost everywhere.
Read them carefully before you pick one. Two of them end in a guilty plea. Only one keeps a shot at a dismissal.
Driver Defense Team traffic ticket lawyers defend drivers in Cook, DuPage, Kane, Lake, and Will. Free case evaluation: (312) 487-4700.
Option 1: Pay for a conviction
This is the path we recommend least.
Paying the fine is usually a guilty plea. The court closes the case. You get a conviction on your driving record. That can raise your insurance. Another ticket later can put your license at risk. If you hold a CDL, a conviction can threaten your job even when the ticket was in your personal car.
Paying also ends any chance of a dismissal or a reduction. Once it is paid, the case is over.
Do not pay until you have talked to us.
Option 2: Plead guilty and ask for supervision
This is still a guilty plea — with a different ask.
You plead guilty, usually pay a higher fine, and request court supervision. If the court grants it, you avoid a conviction on your record if you finish the terms. Many people also have to complete an online traffic safety course (often four hours; sometimes eight if you had supervision in the past year).
Supervision is not automatic. You are asking. If the court denies it, you can end up with a conviction anyway.
Supervision is a weaker fit if you already have tickets, you hold a CDL, or you have used supervision recently. Call us before you pick this path. We will tell you whether it helps or hurts your record and your license.
Option 3: Fight the ticket
This is the only path that can still end in a dismissal.
If you do not have a court date yet, we can request one. On each date, your attorney handles the call with the prosecutor and, when needed, the officer. We review the ticket, your abstract, and what you want out of the case — keep insurance down, protect a CDL, clear the charge, or get it over quickly.
Outcomes can include a dismissal, a reduction, supervision negotiated in court, or a trial when that is the right move. Options 1 and 2 cannot get the ticket dismissed. Only fighting it can.
Do you have to be in court?
It depends.
Whether you need to appear for a given date depends on the ticket type, where you live, the courthouse and judge, and the outcome you want. Too many variables for a page promise.
- Petty tickets: some dates you may not need to be there; some dates you do. We will tell you before each date.
- Criminal charges (DUI, aggravated speeding, driving on a suspended or revoked license, and similar): you appear. Some dates are in person. Some may be Zoom if that court authorizes Zoom for that date. Do not skip a criminal court date.
We will not tell you on a website that you can skip court. Call us with the citation. We will map each date.
What to do today
- Do not pay or mail the ticket until you have a plan.
- Read the charge. Petty and criminal are not the same.
- Note the courthouse, county, and any date on the citation or bond sheet.
- Pull your driving abstract if you can — especially with a CDL.
- Call (312) 487-4700. We will walk the three options against your ticket, quote a flat fee, and tell you which dates you need to attend.
FAQs
Is paying the ticket the same as pleading guilty?
Usually yes. Paying closes the case with a conviction on your record.
Is court supervision a conviction?
If the court grants supervision and you finish the terms, you typically avoid a conviction. You still pled guilty to get there, and it is not guaranteed.
Can the ticket get dismissed if I just pay or request supervision by mail?
No. Dismissal only stays on the table if you fight the ticket.
Can Driver Defense Team go to court instead of me?
Sometimes, on some dates, for some tickets — it depends on the charge, where you live, the judge, and what you are asking for. For a criminal offense, you appear. We will tell you for each date.
I have a CDL. Does that change the options?
Yes. A conviction or the wrong supervision outcome can hit your commercial privileges. Talk to us before you pay or mail anything.
